A2. These terms

A2.1
Part A applies when you buy from our website as a consumer, that is, for purposes wholly or mainly outside your trade, business, craft or profession. Orders placed by a business, including on a trade or credit account, are covered by Part B.
A2.2
Please read these terms before ordering. Our Returns Policy, Delivery page and Privacy Policy form part of them. Nothing in these terms affects your legal rights as a consumer.

A3. Your order

A3.1
When you place an order you make an offer to buy. The contract between us is formed when we email you our order confirmation.
A3.2
If we cannot accept your order, for example because an item is out of stock or its price was shown in error, we will tell you and refund anything you have paid in full.
A3.3
Product images are for illustration. Packaging may vary slightly from the pictures, but the product will match its description.

A4. Prices and payment

A4.1
Prices on the website include VAT. The delivery charge is calculated from the weight of your order and the delivery address and is shown at checkout before you pay.
A4.2
You pay when you place your order, by card, Apple Pay or Google Pay. Payments are processed securely by Stripe; we never see or store your full card details.
A4.3
If we discover an obvious pricing error after you have ordered, we will contact you to ask whether you want to continue at the correct price or cancel for a full refund.

A5. Delivery

A5.1
Delivery times and charges are set out on our Delivery page and at checkout. Unless we agree otherwise, we will deliver within 30 days of the order confirmation.
A5.2
If we are late, you may be able to cancel and receive a full refund for anything not delivered. If something outside our control delays your order, we will tell you and do what we can to limit the delay.
A5.3
The goods are your responsibility from the time they are delivered to you or to someone you nominate, and they become yours once we have received full payment.

A6. Your right to change your mind

A6.1
Under the Consumer Contracts Regulations 2013 you may cancel your contract within 14 days, without giving any reason. The period ends 14 days after the day you, or someone you nominate, receive the goods; if your order arrives in several deliveries, 14 days after the day the last one arrives.
A6.2
To cancel, tell us clearly before the period ends, for example by email to [email protected] or by post to our address. You may use the model cancellation form below, but you do not have to.
A6.3
Send the goods back to us within 14 days of telling us that you are cancelling. You pay the direct cost of returning them.
A6.4
We will refund all payments for the cancelled goods, including the standard delivery charge (if you chose a more expensive delivery option, we refund the standard rate), within 14 days of receiving the goods back or of you showing us proof that you sent them, whichever is earlier. We refund to your original payment method and charge no fee. We do not charge a restocking fee.
A6.5
We may reduce the refund to reflect any loss in value caused by handling the goods more than was needed to establish their nature, characteristics and functioning. Returning goods without their original packaging does not remove your right to cancel.
A6.6
The right to cancel does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons, such as toiletries, cosmetics and toothbrushes, once they have been unsealed after delivery. It applies only to goods that were sealed when delivered.

Model cancellation form (complete and return only if you wish to cancel): To Toiletry Packs, Unit X003, 107 Westmead Road, Sutton, SM1 4JD, United Kingdom, [email protected]. I hereby give notice that I cancel my contract of sale of the following goods: [items], ordered on [date] / received on [date], order number [number]. Name: [name]. Address: [address]. Date: [date].

A7. Faulty goods and your legal rights

A7.1
We must supply goods that are as described, fit for purpose and of satisfactory quality. Under the Consumer Rights Act 2015, if goods are faulty you are entitled to a full refund within 30 days of delivery; after that, to a repair or replacement, or to a refund or price reduction if a repair or replacement is not possible or does not fix the problem. These rights apply for up to six years.
A7.2
Please tell us about a fault as soon as you can, with a photo if possible, so we can resolve it quickly. We pay the cost of returning faulty goods and refund the original delivery charge. Our Returns Policy explains the steps. For advice about your legal rights, visit Citizens Advice.

A8. Our responsibility to you

A8.1
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or of our failing to use reasonable care and skill.
A8.2
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your legal rights in relation to the goods.
A8.3
We supply goods for domestic and private use only. We are not responsible to consumers for business losses, such as loss of profit or business interruption.

A9. Your personal data

We use your personal data only as described in our Privacy Policy.

A10. Complaints, law and courts

A10.1
If you have a problem, please contact us first at [email protected]; we aim to respond within 2 working days.
A10.2
Part A is governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland, you can also bring them in your local courts.
A10.3
We may update these terms from time to time; the terms in force when you place your order apply to it. If a court finds part of these terms invalid, the rest continue to apply. Nobody other than you and us has any rights under your contract.

Basis of Contract

2.1

2.2
Any quotation issued by the Seller shall not constitute an offer but an invitation to treat.
2.3
A Contract is formed only when the Seller confirms an Order in writing or delivers the Goods.
2.4
The Buyer shall ensure that the details of its Order are complete and accurate.
2.5
No variation to these Conditions shall be binding unless agreed in writing by an authorised officer of the Seller.

The Goods are described on the Seller's website or quotation.
3.2

Delivery and Risk

Delivery dates are estimates only. Time of delivery is not of the essence.
4.2
Where Toiletry Packs arranges transport, risk in the Goods passes to the Buyer upon arrival at the delivery address immediately prior to unloading.
4.3
Where the Buyer collects or nominates its own carrier, risk passes when the Goods are made available for collection.
4.4
The Buyer must inspect the goods immediately on delivery and note any damage or shortage on the carrier's delivery record (Proof of Delivery). Claims for transit damage, shortage, or visible defect must be notified in writing within 24 hours of delivery, supported by clear photographs showing all sides of the affected box or pallet. Claims without such photographic evidence will not be accepted.
4.5
A carrier's signed or electronically confirmed Proof of Delivery (POD), including confirmation by a third-party courier acting on behalf of the Buyer, shall be conclusive evidence that delivery was completed in good order unless the Buyer provides written notice of loss or damage within 24 hours, accompanied by the required photographic evidence.
4.6
Toiletry Packs shall not be liable for any loss or damage occurring after the point of risk transfer. The Buyer is responsible for maintaining suitable transit-damage insurance once risk has passed.

5.4
Returned Goods must be unused, in original packaging, and accompanied by written authorisation from the Seller before dispatch.
5.5
Approved returns will be credited at the invoice price only; no deductions or replacements will be issued without prior written agreement.

Title and Ownership

6.1
Title to the Goods shall not pass to the Buyer until the Seller has received full payment for (a) those Goods; and (b) any other Goods previously supplied to the Buyer.
6.2
Until title passes, the Buyer shall:
  • Store the Goods separately and clearly marked as property of Toiletry Packs;
  • Not alter or remove identifying labels;
  • Maintain the Goods in saleable condition and insure them for their full value;
  • Immediately notify the Seller if any insolvency or enforcement event occurs.

Prices are quoted exclusive of VAT and transport unless stated otherwise.
7.2
Invoices are due Net 30 days from invoice date unless agreed in writing.

7.5
All credit accounts are provided under the Seller's trade credit insurance facility underwritten by Allianz Trade.
7.6
Credit limits are set and reviewed by Allianz Trade. Once a Buyer reaches or exceeds its insured limit, or if cover is withdrawn, all further deliveries will be suspended until payment is received or cover reinstated.
7.7
Until written credit approval is confirmed, all orders must be paid in full prior to dispatch.

Limitation of Liability

8.1
Nothing in these Conditions limits or excludes the Seller's liability for death or personal injury caused by negligence, fraud, or any matter that cannot be excluded under English law.
8.2
Subject to 8.1, the Seller shall not be liable for:
  • Loss of profit, business, or goodwill;
